1. Eligibility

By using the App, you confirm that:

• You meet the age requirement

• You have the legal capacity to read these Terms

• You will comply with all applicable laws and regulations

2. Account Registration

To use CAPTAIN, you must create an account.

You agree to:

• Provide accurate and up-to-date information

• Keep your login credentials secure

• Be responsible for all activity under your account

CAPTAIN is not responsible for unauthorized access caused by your failure to safeguard credentials.

3. Nature of the Service (Important)

CAPTAIN provides:

• Training tools

• Performance tracking

• AI-generated recommendations and analytics

CAPTAIN does not provide medical, health, or professional coaching services.

All training suggestions are:

• Informational and educational

• Based on user-provided data

• Not a substitute for professional advice

You are solely responsible for how you train and perform physical activity.

4. User Responsibilities

By using CAPTAIN, you agree to:

• Use the App for lawful purposes only

• Not misuse, exploit, or attempt to reverse engineer the App

• Not submit false, abusive, or harmful content

• Respect other users and the CAPTAIN platform

You must stop using the App immediately if you experience pain, injury, or health issues related to physical activity.

5. Prohibited Conduct

You may not:

• Use CAPTAIN for illegal or harmful activities

• Attempt to bypass security or access restricted systems

• Manipulate metrics, leaderboards, or analytics

• Abuse free trials, promotions, or subscription systems

• Harass, threaten, or impersonate others

Violation of these rules may result in temporary suspension, permanent termination of the account, loss of access to services, and, where appropriate, legal action, including claims for damages or reporting to competent authorities.

6. Subscriptions & Payments

6.1 Free and Premium Access

CAPTAIN offers:

• A free version with limited features

• A Premium subscription with advanced AI features and analytics

Both Free and Premium features may change over time.

6.2 Billing

• Subscriptions are billed via Apple App Store or Google Play Store

• CAPTAIN does not process payments directly

• Pricing and billing cycles are shown at purchase

6.3 Auto-Renewal

Subscriptions automatically renew unless canceled through the App Store or Play Store before the renewal date.

6.4 Refunds

Refunds are handled exclusively by Apple or Google according to their policies. CAPTAIN cannot issue refunds directly.

7. AI-Generated Content

CAPTAIN uses automated systems and AI to generate insights, summaries, and training recommendations.

You acknowledge that:

• AI outputs may contain inaccuracies

• Results depend on the quality of your input data

• AI content is advisory, not guaranteed

CAPTAIN is not liable for decisions made based on AI-generated content.

8. Intellectual Property

All content in CAPTAIN, including:

• Text

• Visuals

• Workouts

• Logos

• Software

• AI outputs

is owned by or licensed to CAPTAIN.

You may not copy, distribute, or commercially exploit any part of the App without prior written consent.

9. User-Generated Content

You retain ownership of the data you submit.

By using CAPTAIN, you grant us a non-exclusive, worldwide, royalty-free license to process and use your data solely to operate and improve the App.

10. Account Suspension & Termination

CAPTAIN reserves the right to:

• Suspend or terminate accounts

• Restrict access to features

• Permanently ban users

This may occur if you:

• Violate these Terms

• Abuse the platform

• Engage in fraud or harmful behavior

In such cases, CAPTAIN may retain limited essential data as described in the Privacy Policy.

11. Data Protection & Privacy

Your use of CAPTAIN is subject to our Privacy Policy, which explains how personal data is collected and processed.

By using the App, you acknowledge and accept the Privacy Policy.

12. Service Availability

CAPTAIN is provided on an "as is" and "as available" basis.

We do not guarantee:

• Continuous availability

• Error-free operation

• That all features will remain unchanged

We may update, modify, or discontinue parts of the App at any time.

13. Limitation of Liability

To the maximum extent permitted by law, CAPTAIN shall not be liable for:

• Injuries or damages resulting from training activities

• Loss of data, profits, or business opportunities

• Decisions made based on AI recommendations

• Service interruptions or technical issues

Your use of CAPTAIN is at your own risk.

14. Indemnification

You agree to indemnify and hold harmless CAPTAIN from any claims, damages, or expenses arising from:

• Your misuse of the App

• Your violation of these Terms

• Your violation of applicable laws

15. Changes to the Terms

We may update these Terms from time to time.

Material changes will be communicated via the App or other reasonable means. Continued use constitutes acceptance of the updated Terms.

16. Governing Law & Jurisdiction

These Terms are governed by the laws of Portugal / European Union, without regard to conflict of law principles.

Any disputes shall be subject to the exclusive jurisdiction of the competent courts.
